While the Russian aggression continues against Ukraine, the Berlin Film Festival carries on.

One of the political hi-lites of the 2023 Festival is the premier of Sean Penn’s documentary ‘Superpower’.

As the following DW piece indicates this documentary about Volodymyr Zelenskyy was planned before Putin invaded Ukraine a year ago.

The onset of the Russian aggression and Zelenskyy’s leadership makes the film all the more powerful and poignant.

The actor-director’s highly anticipated documentary about Volodymyr Zelenskyy and the Ukrainians’ fight for democracy has premiered at the Berlin International Film Festival.

Three months before the invasion, Sean Penn and his film production team were already in Ukraine, preparing a documentary that would profile Volodymyr Zelenskyy’s atypical career trajectory from actor-comedian-producer to president.

But that story took an unexpected turn when Russia invaded Ukraine, leading the still relatively inexperienced politician to become a wartime leader. 

The ensuing documentary, “Superpower,” co-directed by Sean Penn and Aaron Kaufmann, premiered on Friday at the Berlinale.

The premiere came a day after Penn’s appearance on stage at the film festival’s opening ceremony, where he introduced a live video address by the Ukrainian president.

“Superpower” offers a good introduction to how the comedic superstar, as a Russian-speaking Jew, did not fit into Putin’s propaganda narrative that Ukraine is filled with neo-Nazis who want to deprive the ethnic Russian population of their rights. That didn’t stop the Kremlin from branding Zelenskyy as a Nazi, though.

The film also shows how the Ukrainians’ own perception of Zelenskyy evolved within a few months.

In interviews shot in December 2021, different people admit that they didn’t vote for him, skeptical of his ties to oligarchs as a powerful TV producer, all while accepting that he was still “the lesser of all evils.” A Crimea veteran says the president unfortunately “probably doesn’t have the balls” to face Putin.

But Zelenskyy did become the unifying leader of Ukraine, notably by staying in his country to defend it instead of fleeing, famously declining US President Joe Biden’s offer to help him leave by stating, “I need ammunition, not a ride.”

A year into the conflict, Russia’s continued attacks and the growing number of casualties make it hard to conclusively define the leader’s legacy: “Zelenskyy went beyond expectations, but Russia is not going anywhere,” as one expert interviewed in the film puts it.

But Sean Penn definitely found a figure of hope in Zelenskyy, one he believes should inspire Americans to remember “that their hardwired sense of freedom shouldn’t be taken for granted.”

Seymour Hersh has been around the Washington block for decades.

He knows of what he speaks. His latest report published in substack.com has received vigorous pushback from the Biden Administration.

Hersh claims that the United States was responsible for destroying the Nordstream 2 pipeline in September 2022 which was set to carry natural gas from Russia to Germany.

The American administration has been consistent in its disavowal of any involvement. Instead attempting to cast responsibility on Russia.

Seymour Hersh was interviewed at length on Democracy Now last week. A link to this fascinating interview is attached.

The American mainstream media has been totally derelict in not following up on this story though it finally seems to be gaining traction in international media.

The source had a much more streetwise view of Biden’s decision to sabotage more than 1500 miles of Gazprom pipeline as winter approached. “Well,” he said, speaking of the President, “I gotta admit the guy has a pair of balls.  He said he was going to do it, and he did.”

Asked for comment, Adrienne Watson, a White House spokesperson, said in an email, “This is false and complete fiction.” Tammy Thorp, a spokesperson for the Central Intelligence Agency, similarly wrote: “This claim is completely and utterly false.”

Biden’s decision to sabotage the pipelines came after more than nine months of highly secret back and forth debate inside Washington’s national security community about how to best achieve that goal. For much of that time, the issue was not whether to do the mission, but how to get it done with no overt clue as to who was responsible.

In the immediate aftermath of the pipeline bombing, the American media treated it like an unsolved mystery. Russia was repeatedly cited as a likely culprit, spurred on by calculated leaks from the White House—but without ever establishing a clear motive for such an act of self-sabotage, beyond simple retribution. A few months later, when it emerged that Russian authorities had been quietly getting estimates for the cost to repair the pipelines, the New York Times described the news as “complicating theories about who was behind” the attack. No major American newspaper dug into the earlier threats to the pipelines made by Biden and Undersecretary of State Nuland.

While it was never clear why Russia would seek to destroy its own lucrative pipeline, a more telling rationale for the President’s action came from Secretary of State Blinken.

Asked at a press conference last September about the consequences of the worsening energy crisis in Western Europe, Blinken described the moment as a potentially good one:

“It’s a tremendous opportunity to once and for all remove the dependence on Russian energy and thus to take away from Vladimir Putin the weaponization of energy as a means of advancing his imperial designs. That’s very significant and that offers tremendous strategic opportunity for the years to come, but meanwhile we’re determined to do everything we possibly can to make sure the consequences of all of this are not borne by citizens in our countries or, for that matter, around the world.”

More recently, Victoria Nuland expressed satisfaction at the demise of the newest of the pipelines. Testifying at a Senate Foreign Relations Committee hearing in late January she told Senator Ted Cruz, “​Like you, I am, and I think the Administration is, very gratified to know that Nord Stream 2 is now, as you like to say, a hunk of metal at the bottom of the sea.”

Asked why he thought the Russians failed to respond, he said cynically, “Maybe they want the capability to do the same things the U.S. did.

“It was a beautiful cover story,” he went on. “Behind it was a covert operation that placed experts in the field and equipment that operated on a covert signal.

“The only flaw was the decision to do it.”

Refusal by the Socialist Party (SPD) incumbent Mayor Franziska Giffey to follow the will of the voters who want expropriation of major Berlin landlords has completely disrupted the political status quo.

BERLIN—An unprecedented do-over election here last Sunday, February 12, put the notoriously left-wing German capital on the precipice of conservative government for the first time in two decades.

While the city of Berlin was never viewed as the paragon of German efficiency, the 2021 election mess is still remarkable: polling sites without enough ballots, or with the wrong ones; hours-long lines that delayed voting into the night; a marathon race on polling day that blocked traffic across the capital.

While the election hiccups are one obvious reason for discontent, another equally troubling issue is Mayor Franziska Giffey’s pointed refusal to take action in response to a historic 2021 referendum that saw 59.1 percent of voters endorse expropriating major landlords in the city to order to increase the supply of publicly-held housing.

The revote for state and municipal government—ordered by the state’s constitutional court after widespread mishandling of the September 2021 polls—saw support for the Social Democrats (SPD) plummet, while the rival Christian Democrats (CDU) surged more than 10 percent to 28.2 percent to take the clear lead among parties.

“Berlin chose change,” proclaimed Kai Wegner, the CDU’s top candidate—albeit a bit prematurely.

While negotiations may still return the Red-Red-Green coalition of the SPD, the Green party and the Left party to power with a narrow majority, the results signal deep discontent among Berliners about the direction of the city under SPD Mayor Franziska Giffey. Support for her party fell to 18.4 percent—its lowest since German reunification—putting them in a practical tie for second place with the Greens, while the Left party maintained its traditional base of support, with 12.2 percent.

The far-right Alternative for Germany (AfD) also maintained its appeal among a small swath of voters in the latest poll with 9.1 percent support, despite having almost no chance of entering government. Complex negotiations could take up to six weeks before party leaders agree on a coalition arrangement.

Support for the successful campaign “Deutsche Wohnen & Co Enteignen” (Expropriate Deutsche Wohnen and Co.), which I covered for The Nation, cut across many social groups outside the traditional hard left, including many SPD voters. No wonder, in the face of a housing crisis and indifferent leadership, 68 percent of Berliners recently reported that their trust in political institutions had declined.

When the Constitutional Court finally threw out the results more than a year after the botched vote, SPD leadership failed to take ownership of the situation, giving an easy attack line to the opposition on the right who claimed that the city was poorly run. Wegner and other CDU politicians engaged in dog-whistle politics connecting the narrative of urban mismanagement by City Hall to crime and disorder in the streets, especially after New Year’s Eve “riots” in several immigrant-heavy neighborhoods.

The People prevailed!!! The entitled motorists lost!!!!

Rejoice.

In the dry anodyne world of legal writing the California Court of Appeal has sent a powerful message.

“On the court’s own motion” a three Justice panel in San Francisco has shut down the last gasp attempt by the entitle motorists to bring back cars to The Great Walkway and JFK Promenade.

The will of the voters in San Francisco, along with actions of the Board of Supervisors and The Mayor is now recognized and acknowledged. It is now the law. The environment where people can enjoy two small spaces of land without the disruptive influence of climate killing cars is a reality.

Advocates for the entitled motorists have spent hundreds of thousands at the ballot box and in the courts in pursuit of their selfish self interest to drive their cars anywhere, anytime, anyplace.

Proponents of the measure to return cars to JFK Promenade were primarily funded by the Fine Arts Museums of San Francisco. The FAMSF spent 200K to place Proposition I on the ballot. FAMSF spent nearly 800K in total pushing this measure. FAMSF was also a plaintiff in the now dismissed lawsuit.

BY THE COURT:

For the following reasons, this appeal is dismissed on the court’s own motion after briefing by the parties.

According to the appellate record, respondents closed a portion of San Francisco’s Great Highway to motor vehicle traffic in March 2020 to give the public a safe and socially-distanced recreation area during the COVID-19 pandemic. In August 2021, as pandemic-related restrictions eased, respondents modified the closure so it applied only on weekends (Friday noon to Monday 6 a.m.) and holidays. The closure was set to expire at the end of the COVID-19 state of emergency on February 28, 2023.

In December 2021, appellants filed a complaint against respondents, seeking a preliminary injunction on the ground that respondents lacked authority for the closure under Vehicle Code section 21101. Appellants also argued that respondents violated Vehicle Code section 21101.6 and San Francisco Park Code section 3.03. Appellants filed a motion for a preliminary injunction on those grounds, which the trial court denied in February 2022. Appellants brought the instant appeal challenging the denial.

In November 2022, while the appeal was pending, San Francisco voters rejected Proposition I, which had called for a reopening of the Great Highway. We thereafter asked the parties to state whether the election results or any other matter since the filing of the appeal rendered the appeal moot.

On December 2, 2022, respondents asserted that the appeal would likely become moot when the closure expired under its then-existing authority at the end of the state of emergency in February 2023 and pursuant to possible future legislation by the City of San Francisco. Appellants, after receiving two extensions to file their letter brief, argued in a letter dated December 23, 2022 that the appeal was not moot. We set the appeal for oral argument.

On January 23, 2023, respondents filed a motion for judicial notice of a new ordinance that now closes the Great Highway for a different reason – to improve a storm water infrastructure program. Respondents asserted that the appeal had therefore become moot. On January 26, 2023, we issued an order to show cause, acknowledging our receipt of respondents’ motion for judicial notice and informing the parties of our intent to grant the request for judicial notice and, on our own motion, to dismiss the appeal as moot.

We offered appellants seven days to show cause why the request for judicial notice should not be granted and/or why the appeal should not be dismissed, and we offered respondents three days after the filing and service of appellants’ letter brief to respond.

On February 2, 2023, appellants responded by letter brief. Appellants did not oppose the request for judicial notice but argued that the appeal was not moot “for the reasons set forth in their Dec. 23, 2023 Letter Brief.”

On February 6, 2023, respondents filed a letter brief explaining why the appeal is moot and should be dismissed.

Having considered the parties’ letter briefs, we grant the request for judicial notice and conclude the appeal is moot. Because the closure of the Great Highway is now based on the authority of the new ordinance, this court cannot provide any effectual relief in ruling on the appeal. (Wilson & Wilson v. City Council of Redwood City (2011) 191 Cal.App.4th 1559, 1574.) Even if we were to agree with appellants’ arguments on appeal, appellants have not demonstrated that such a ruling would preclude respondents from keeping the Great Highway closed for a different purpose under the new ordinance. Furthermore, the issues presented in the appeal turn largely on the scope of respondents’ authority in the context of the COVID-19 pandemic, and appellants have not shown that the issues are likely to repeat, or that there is otherwise a reasonable expectation that the allegedly wrongful conduct will be repeated, such that we should exercise our discretion to address them. (RGC Gaslamp, LLC v. Ehmcke Sheet Metal Co., Inc. (2020) 56 Cal.App.5th 413, 434.)

The appeal is dismissed. The matter is removed from the February 2023 oral argument calendar. Each party shall bear its own costs on appeal.

San Francisco tries in vain to crack down on drug use on the streets.

Seemingly unable to adopt a policy which provides necessary treatment.

The forces of law and order push for harsh treatment against those who sell the product.

As City Hall dawdles people continue to die on the streets.

Makes me harken back to 1967 when Van Morrison released his classic song T.B. Sheets. It was a staple on KSAN FM rock radio and I heard it nearly every night.

A reporter who was covering a news conference on the train derailment in Ohio that led to the release of toxic fumes was arrested following a live shot on Wednesday, after officers told him to be quiet while the governor spoke, according to the cable channel where he works, NewsNation.

Reporter Evan Lambert is heard saying in a video from WKYC Studios, a television station, “I’m doing my job.”

He told the four officers not to touch him as they circled around him. Then the officers and Mr. Lambert moved toward a hallway, where two officers placed Mr. Lambert on the ground on his stomach, video of the encounter shows. A witness can be heard saying, “Oh my God, you guys this is bad, stop.”

Lambert, had been waiting for the news conference in East Palestine, Ohio, to start at 3 p.m., but it was delayed until about 5.p.m. The later time coincided with when he was scheduled to do a live shot for the show, Mike Viqueira, the Washington Bureau Chief of NewsNation, said in an interview on Wednesday night.

Mr. Lambert was charged with disorderly conduct and criminal trespassing, according to Lt. Seth Fraser of the Columbiana County Jail in Ohio. Lieutenant Fraser said in a brief interview on Wednesday evening that Mr. Lambert would be held in the jail overnight and arraigned on Thursday morning.

But on Wednesday night, NewsNation reported that Mr. Lambert had been released from jail and broadcast an interview with him moments after he was freed.

When asked by other reporters at the news conference about the episode, Ohio Governor Mike DeWine said that it has always been his practice to allow reporters to talk to viewers live as he speaks at news conferences.

“If someone was stopped from doing that, or told they could not do that, that was wrong,” he said. “It was nothing that I authorized and certainly would be something I would not want to see happen.”

San Francisco District Attorney Chesa Boudin has had enough of the treacherous political animal DA Brooke Jenkins who spearheaded the June 2022 political lynching which drove him from office.

Chesa has maintained a diplomatic silence during the past eight months.

But the blatant miscarriage of justice being perpetrated by Brooke Jenkins in dropping the prosecution of a San Francisco cop who gunned down a man on the streets of San Francisco was the final straw.

Brooke Jenkins in an act of total prosecutorial hypocrisy accuses Chesa Boudin of misconduct in pursuing criminal charges against the ex-cop. For that reason she intends to drop the case just as the Statute of Limitations is due to expire.

Chesa Boudin should run to gain back the office which was stolen from him by Mayor London Breed and the City Hall lifers who never considered Chesa part of the inside gang.

These people, with 9MM in funding from the most reactionary sources in America, were able to con the voters and were victorious in their effort to drive him from office.

Brooke Jenkin’s seven month tenure has done nothing to stop crime in San Francisco. The only difference now is that the law and order loving mainstream media is not holding her accountable for the lawlessness which pervades this City.

San Francisco needs to have an open and honest discussion about criminal justice in San Francisco. Not the MAGA charade foisted on the people in 2022.

DA Brooke Jenkins’ dismissal of the Christopher Samaoya case is offensive and her excuses are dishonest: we charged this case based on the facts–the same facts that led the police department to fire the officer, led the judge to sign the arrest warrant.

The same facts that led the city to settle a multi-million dollar lawsuit with Keita O’Neil’s family.

It’s clear Jenkins has been coordinating with the officer’s defense team (police union lawyers) to avoid a public hearing on the disturbing facts of the case.

Jenkins is scapegoating me to try to divert attention from what this decision ultimately reveals about her: Jenkins will not hold everyone equally accountable under the law, she is deeply politically motivated, and she does not care about victims of police violence. Shame.

Folks just don’t want to believe there are Nazis lurking in the streets of San Francisco.

Shocking as it may seem and impossible to comprehend, these despicable people can be found in my quiet Outer Richmond District neighborhood close by the Pacific Ocean.

Nazis are depraved and dangerous people who need to be stamped out and obliterated.

This horrific story was first picked up by the Northern California Jewish Weekly and is now making its way into the mainstream media.

A man who appears to have posted Nazi imagery on social media before firing blanks from a pistol in a San Francisco synagogue will face allegations that he committed a hate crime, prosecutors said Wednesday.

Dmitri Mishin, 51, was arrested following a bizarre chain of events that peaked Feb. 1 when he allegedly fired the fake gunshots at a gathering of worshippers inside the Richmond District’s Schneerson Center.

On Wednesday, District Attorney Brooke Jenkins decided to file numerous charges against him including hate crime allegations and counts of making threats, obstructing a religious meeting and brandishing a replica firearm.

“This is another deplorable example where our Jewish community has been targeted for who they are and what they believe,” Jenkins said in a statement. “There is no doubt that antisemitism is real and we must stand with our Jewish community against it.”

The startling incident rattled a close-knit community in the Richmond District that includes many Russian-speaking immigrant elders. But religious leaders weren’t sure what to make of it until social media posts emerged showing the gunman may have harbored antisemitic views—and even dressed like a Nazi.

“I’m happy this person is getting the charges he deserves,” said rabbi Alon Chanukov, “and I hope that he’s put away for a very long time and that the community can unify against this behavior.”

The shooting has raised security concerns for the Schneerson Center, a storefront synagogue located on a largely residential section of Balboa Street.

Police have placed a patrol car outside the building on Shabbat, the weekly Sabbath when there are more worshippers, Chanukov told The Standard a day before the charges were announced. But it’s unclear how long that will last.

“The big synagogues already have the guards; they have the funding, everything,” he said.

Mishin is expected to be arraigned Wednesday at 1:30 p.m.
